Vehicle hit by a drunk driver, 2 dead

Two people are dead following a serious crash in Madison Township that is believed to have been predicated on drunk driving, according to local sources. Police in the Ohio township did not arrest the suspected drunk driver because both the driver and passenger in the offending vehicle were killed in the crash. The individual in the other vehicle survived, and refused treatment. 

According to officers on the scene, the 28-year-old driver suspected of DUI was reportedly heading southbound on Elk Creek when the accident occurred. It appears the driver failed to stop at a marked stop sign, and the vehicle pulled in front of a pickup truck driven by a 51-year-old person. The force of the resulting impact sent both vehicles off the road and into a ditch. 

The driver of the offending vehicle, as well as a 19-year-old female passenger, were both pronounced dead at the scene. A 23-year-old female passenger was rushed to a local hospital via airlift. She remains in unknown condition as of this report. Police believe alcohol played a role in the crash, but their investigation remains underway. 

While the occupant of the vehicle hit by a drunk driver was thankfully not hurt in the crash, Ohio state law allows the family of the deceased passenger as well as the surviving passenger to file civil suits against the driver's estate. If it can be proven the driver was drunk at the time of the crash, this could provide compelling evidence to a civil court if the family or the surviving individual wish to file wrongful death or personal injury lawsuits in this case. This could go a long way toward the court ruling in favor of the family.
