What types of damages are available to car accident victims?

There are a variety of different types of damages that car accident victims may suffer and may be able to recover compensation for through a personal injury claim. Car accident victims may wonder, however, what damages are available to them to them when they have been injured. Because a claim for damages can help victims recover compensation for the injuries, harm and expenses they have suffered, it is important for victims to be familiar with the options available to help them.

Victims of car accidents may have claims for medical expenses, lost wages, lost earning capacity, pain and suffering and loss of consortium. Medical expenses following a car accident can be significant and may begin to pile up. Additionally, car accident injuries may worsen following the accident, so it is important for car accident victims to seek medical care and treatment and submit to a thorough medical examination.

Medical expenses can be extensive and can include: ambulance costs; physical and cognitive therapy, especially the latter in circumstances when the victim has suffered a brain injury; consultation with health care professionals; medical accessories such as crutches; disfigurement; permanent disability; and in-home treatment and care. A reasonable estimation of medical care expenses and costs, including future medical care expenses and costs, may be used to determine damages suffered.

In addition, car accident victims may have difficulty earning a living following a car accident because they are unable to work due to the injuries they have suffered. To determine damages for diminished employment opportunities, the age, occupation, skill, experience and life expectancy of the victim will be evaluated. Pain and suffering damages for the emotional distress suffered as a result of a car accident may also be available to victims injured in a car accident. Damages depend on the circumstances of the car accident, the characteristics of the victim and the nature of the injuries suffered, which is why it is important for car accident victims to be familiar with the types of damages and legal options available.
